Last update: January 6, 2015

Sportwip knows that you care about how information about you is collected, used and shared, and we appreciate that you trust us to do so carefully. Please take a moment to review our Privacy Policy, which covers the information Sportwip collects when you use our services (the “Sportwip Services”).

Our mission is to add a fun dimension of positive recognition to leading a healthy lifestyle. We connect you with an inspiring social community, and valuable rewards from businesses that applaud your healthy choices. In order to authenticate and empower our members, Sportwip collects and stores information about our members to verify identity and activity. This information enables Sportwip to communicate with you directly and in turn, reward you for your healthy lifestyle.

This policy governs the use of the Sportwip website located at Sportwip.com (the "Site"), as well as any of our other web sites, networks, embeddable widgets, downloadable software, or mobile or tablet computer applications, features, or services, whether on-line or off-line, owned or operated by us and on which a link to this policy is displayed (collectively, the “Service”).

Your privacy is paramount, so we have prepared this privacy policy to describe what information we collect, how we use and disclose it, and who to contact if you have questions. We've also built Sportwip to give you personally identifiable information (which we refer to as “personal information”) in this policy.

In this policy, the terms “Sportwip,” “we,” “us,” and “our” refers to Sportwip, Inc., and its affiliates. The terms “you,” “your,” and “yours” refer to the user (end user) utilizing the Service. This policy is incorporated into and subject to our Terms of Service, and capitalized terms used but not defined in this policy are defined in our Terms of Service.

Voluntarily-Provided Information

We collect information that you voluntarily provide when you sign up for Sportwip, as well as information when you sign up from certain third-party social networking sites (including, but not limited to, Facebook). We may ask you for certain information such as name, email address, password, your employer and birthday. We use this information to fulfill your requests for products or services, communicate with you, personalize your experience on Sportwip, and to improve our services.

If you connect your Sportwip account to Facebook or another third-party service, you authorize us to access and store all information related to your account on the third-party service that may be accessible to us through such third-party service, such as the credentials you provide, your name, email address(es), date of birth, gender, current city, and profile picture URL. If you connect your Sportwip account to Facebook or another social networking service, we will make your name and/or username and profile photo on that social networking service visible to other users of Sportwip. We encourage you to check your Facebook and other applicable social networking privacy settings to understand and change the information sent to us through Facebook Connect or other third-party social networking services.

We also collect other information you provide to us through other means when using the Services, such as when you fill out or update a user profile on the Services, when you contact us to redeem rewards, or when you contact us to request help or support. Also, our Services may contain interactive functionality that allows you to engage with other users on the Services, post comments to other users' profiles, and to upload photographs and other content (the “User Materials”), participate in surveys, and otherwise to interact with the Services and with other users. We collect any information, including personal information that you post or transmit in the course of using these interactive features.

When you visit our Services, some information is collected automatically. For example, when you access our Services, we automatically collect your browser's IP address, your browser type, the nature of the device from which you are visiting the Services (e.g., a personal computer or a mobile device), the identifier for any handheld or mobile device that you may be using, the Web site that you visited immediately prior to accessing any Web-based Services, the actions you take on our Services, and the content, features, and activities that you access and participate in on our Services. We also may collect information regarding your interaction with e-mail messages, such as whether you opened, clicked on, or forwarded a message.

We may collect this information passively using technologies such as standard server logs, cookies, and clear GIFs (also known as “Web beacons”). We use passively-collected information to administer, operate, and improve the Website and our other services and systems, to improve the effectiveness of advertising on our Services, and to provide advertisements and other content that is tailored to you. If we link or associate any information gathered through passive means with personal information, or if applicable laws require us to treat any information gathered through passive means as personal information, we treat the combined information as personal information under this policy. Otherwise, we use and disclose information collected by passive means in aggregate form or otherwise in a non-personally identifiable form.

We may receive information about you, including personal information, from third parties, and may combine this information with other personal information we maintain about you. If we do so, this policy governs any combined information that we maintain in personally identifiable format.

Our use of your information.

We use your information to provide you with:

We also use information we collect from you to prevent fraudulent use of our Services and other systems; to prevent or take action against activities that are, or may be, in violation of our Terms of Service, or applicable law; for other administrative purposes; and for other purposes to which you may provide your consent.

How we share your information.

Except as described in this policy, we will not disclose personal information that we collect on our Services to third parties without your consent. We may disclose information to third parties if you consent to us doing so, as well as in the following circumstances:

We may disclose personal information to third-party service providers (e.g., payment processing and data storage and processing facilities) that assist us in our work. We limit the personal information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain its confidentiality.

Some features on our Services may allow you to upload, post, or otherwise transmit User Materials to public areas of the Services, such as content that you post in a public profile on the Services or in other public areas. Please be aware that any personal information that you include within any User Materials will be made available to other users of the Services. We may allow you to select privacy options that limit access to some types of personal information in User Materials, but these measures may not prevent access to all information you include in public posts. Even after information posted on the Website is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Services. We cannot warrant or guarantee that any personal information that you provide on and in connection with the Services will not be accessed, viewed, or used by unauthorized persons.

Information about our users, including personal information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets.

We also disclose personal information if we believe that doing so is legally required, or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others, or otherwise to help protect the safety or security of our Services and other users of the Services.

We may disclose aggregated or other types of non-personal information, including “automatically collected” and “cookies” information that are non-personally identifiable, to third parties for various purposes. For example, we may disclose non-personal information to interested third parties to assist them in understanding the usage, viewing, and demographic patterns for certain programs, content, services, advertisements, promotions, or functionality on our Services.

About the information provided by your trusted connections.

We know you're busy, so Sportwip makes it super easy for you to keep tabs on your healthy choices. For example, if you use an activity tracker like a pedometer or FitBit, your stats can be uploaded automatically. When you connect your Sportwip account to third-party services, devices, and social networks Sportwip will collect certain information about your physical activity records, number of steps, and check-in locations. These third-party connections are in your control. You can disconnect or change your privacy settings for each connection at any time. You also should check your privacy settings on these third-party connections to understand and change, if desired, the information sent to us through them.

Links to third-party services.

This Privacy Policy applies only to the Site and Services. If you choose to use any third party sites or services linked within the Services, please be aware that they are not endorsed or reviewed by Sportwip and that this policy will not govern any information you provide to them.

If you wish to access or amend any other personal information we hold about you, you may contact us at [email protected].

International users.

Our Services are hosted in the United States and generally are intended for United States visitors. If you visit from the European Union or other regions with laws governing data collection and use that may differ from United States law, please be aware that you are transferring personal information to the United States. The United States does not have the same data protection laws as the European Union and other regions. By providing personal information to us, you consent to the transfer of it to the United States and the use of it in accordance with this policy and applicable law.

Security.

We use reasonable security measures that are designed to protect personal information from accidental loss, disclosure, misuse, and destruction. Please be aware, however, that no data security measures can be guaranteed to be completely effective. Consequently, we cannot ensure or warrant the security of any information that you provide to us.

Updates to this policy.

We may occasionally update this policy. When we do, we will also revise the “last updated” date at the beginning of the policy. Your continued use of our Services after such changes will be subject to the then-current policy. If we change this policy in a manner that is materially less restrictive of our use or disclosure of your personal information, we will use reasonable efforts to notify you of the change and to obtain your consent prior to applying the change to any personal information that we collected from you prior to the date the change becomes effective. We encourage you to periodically review this policy to stay informed about how we collect, use, and disclose personal information.
